Welcome to NillOne Inv LLC (the "Service"). These Terms of Service ("Terms") govern your access to and use of our Minecraft hosting services, Minecraft network (if applicable), website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access or use the Service.
1.1. Eligibility: You must be at least 13 years old to use the Service. If you are under 13, you must have your parent or guardian's consent to use the Service. If you are a parent or guardian, and you provide consent for your child to use the Service, you agree to these Terms on behalf of yourself and your child.
1.2. Account Creation: To use certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
1.3. Account Security: You are responsible for maintaining the confidentiality of your account password and are fully responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.
1.4. Account Termination: We reserve the right to terminate or suspend your account and access to the Service at any time, for any reason, including but not limited to violations of these Terms, or inactivity. We may, but are not obligated to, provide notice of such termination.
2.1. Service Description and Nature of Service: We provide Minecraft server hosting services. You are leasing server resources, and your use of the Service is a limited license and is not a sale of the server itself. We offer various hosting plans with different resource allocations (RAM, CPU, storage, etc.). The specific features and limitations of each plan are described on our website.
2.2. Nature of Service: You acknowledge and agree that the Service involves a limited license to use server resources and that you do not have complete control over the underlying infrastructure. We retain control of the physical server hardware, network configuration, and overall server environment. The degree of access to modify server files may be limited by your hosting plan. We reserve the right to make changes to the server configuration, including, but not limited to, the operating system, software versions, and security settings, at any time. We will provide reasonable effort to avoid disruptions but cannot guarantee uninterrupted service.
2.3. Acceptable Use: You agree to use the hosting services only for lawful purposes and in accordance with these Terms. You specifically agree not to:
2.4. Server Content: You are solely responsible for the content hosted on your Minecraft server, including but not limited to worlds, plugins, configurations, and user interactions. We are not responsible for the content hosted on your server. You must ensure that your server content complies with these Terms and all applicable laws.
2.5. Backups: We may, but are not obligated to, provide backups of your server data. It is your responsibility to regularly back up your server data. We are not responsible for any loss of data.
2.6. Uptime and Availability and Service Termination: We strive to provide high uptime, but we do not guarantee uninterrupted access to the Service. We reserve the right to shut down or terminate the service, temporarily or permanently, at any time and for any reason, without prior notice. This includes, but is not limited to, system maintenance, security threats, legal requirements, or violations of these Terms. We are not liable for any data loss or other damages resulting from downtime or service termination. We also reserve the right to make changes to server configurations, including plugins, software and network configurations and other aspects of the server as needed to operate the service and maintain security or performance.
3.1. Network Rules: If applicable, use of the network is subject to additional network rules, which are displayed on the network (e.g., in-game rules, on the website). You agree to abide by these rules.
3.2. Player Conduct: You are responsible for your conduct on the network. We reserve the right to ban players for violations of the network rules or these Terms, including but not limited to:
4.1. Pricing: The prices for our hosting plans are displayed on our website. We reserve the right to change our prices at any time. Price changes will be effective for new subscriptions and renewals.
4.2. Payment: You agree to pay all fees and charges associated with your chosen hosting plan. Payment is due in advance of the service period.

5.1. 5.2. Your Intellectual Property: You retain ownership of the content you create on your Minecraft server (e.g., worlds, builds, custom plugins, etc.). However, you grant us a limited license to use your content as necessary to provide the Service.
6.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE PREVIOUS 3 MONTHS.

You agree to indemnify and hold harmless NillOne Inv LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another.
9.1. We reserve the right to modify these Terms at any time. We will post the revised Terms on our website and update the "Effective Date." Your continued use of the Service after the posting of the revised Terms constitutes your acceptance of the changes. It is your responsibility to review these Terms periodically.
10.1. We may terminate your access to the Service, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
11.1. These Terms shall be governed by and construed in accordance with the laws of NM, without regard to its conflict of law principles.
